Debt and Divorce: Your Legal Questions Answered
Questioner
My husband and I are getting divorced; we have a community of property marriage. I don't have any assets of my own in the bank, and I'll be able to get by on my own salary and child support, but I won't have much left. I don't take much stuff from home (rental house). To what extent can creditors contact me? My husband owns a business that was declared bankrupt in the past (although he wasn't. The bankruptcy has since been lifted, but creditors are trying again). He also has some outstanding payments to his name. If I own little to nothing, can they still show up at my door at some point? Or will they keep trying because the 50 euros I might have left won't amount to much?Questioner
Formally, because it concerns a marital dispute, creditors can also contact you. It's best to enter into an agreement with your ex that covers all of this. Creditors can still contact you, but you'll have a right to your ex again. I can assist you with the divorce if you wish.
