r/thenetherlandsQuestion Leaving on probation period u/foteini92 Hello everyone, I am an expat working in the Netherlands and I would really appreciate it if you could help me with a job situation. One and a half month ago i started working at a large fashion company store part time. The day i signed the contract I was told that each payment goes on 28th of each month. The first month I got paid on the 25th. On the second month, that it's still considered probation period, I got 2 weeks holiday for exams in my country, something that was agreed at the interview, before i signed the contract. Today (22th of June) I returned, worked my shift, and told my manager that I would like to quit due to the bad working environment. The thing is, that, for an unexplained reason, I got paid the same day, a lot sooner from when i was expecting. And I've paid the WHOLE month. even the hours that i have not worked yet. And they won't let me leave. They say that i need to work off all the hours I've been paid, even the holiday hours. Is this legal? I mean I got paid a lot sooner, and Im HAPPY to return the extra money, is this possible? can they force me to stay although it is probation period and the contract says 'On the commencement of the employment, there will be a trial period in conformity with '....' collective agreement. During this period both the Employer and the Employee may terminate the employment at any time' I mean. it's not my fault that I got paid so soon and again I WOULD LIKE TO RETURN THE MONEY. But they didnt provide this as an option and they want me to work the extra hours AFTER the ending of the probation period, something that really scares me, because they may not allow me to leave at any time then and I will have to give one month notice. Can someone guide me please on what should I do and what my rights are? Because I have no idea if this is legal and i dont know how to handle this. ( I got paid for 104 hours and i worked until now 20)
